      2. For complaints about false information, cPen Network is responsible for verification, deletion, and public disclosure;
      3. In cases of complaints from users or cases filed by relevant departments, this website will assist in investigations according to the law.
    3. The content posted within cPen Network is exclusively authorized by users. Other related websites may not repost without the consent of cPen Network; otherwise, they will bear all legal responsibilities arising from user complaints, lawsuits, and other legal disputes, and cPen Network will pursue corresponding infringement liabilities.

      The ownership and operation rights of all network services of cPen Network belong to cPen Network.     4. User Obligations

        3. Impersonating any person or entity in any way;
        4. Uploading, posting, sending emails, or transmitting any content that is unauthorized by laws, regulations, contracts, or statutory relationships, or transmitting any information related to national security;
        5. Uploading, posting, sending emails, or transmitting any content that infringes on any person's patents, trademarks, trade secrets, copyrights, or other proprietary rights;
        6. Uploading, posting, sending emails, or transmitting any material containing software viruses or other computer codes, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or communication equipment;
        7. Interfering with or disrupting the network services of cPen Network or the servers and networks connected to cPen Network, not complying with the regulations, statutes, service terms, and operating norms of the networks connected to cPen Network;
    5. Principle of Prohibition on Transfer
      Without the consent of cPen Network, users may not transfer, assign, or even resell all or part of the network services provided by cPen Network under any circumstances.
    6. Modification and Termination of Services
      1. cPen Network has the right to temporarily or permanently modify, suspend, or terminate services (or any part thereof) at any time, with or without notice, and shall not be liable for any modifications, suspensions, or terminations to users or any third party;
      2. In the event that a user is deemed to have violated the service terms (including but not limited to this reason), cPen Network has the right to terminate the username, user password, or network services, or delete any content that the user has posted on cPen Network, with or without notice, and cPen Network shall not be liable to users or any third party.
  5. Account Security and Recovery

      4. Logging out of their account when using shared devices

      8. Ensuring the cPen Network app is not accessible by unauthorized users on their devices
      9. Logging out of the cPen Network app when devices may be accessed by others
    2. Unauthorized Access
      Unauthorized access includes but is not limited to:
      1. Access by individuals who are not the registered account holder
      2. Access through stolen or compromised credentials
      3. Access through social engineering or phishing
      4. Unauthorized modification of account information including email addresses and passwords
    3. Investigation and Recovery Rights
      cPen Network reserves the right to:
      1. Investigate any suspected unauthorized access to user accounts
      2. Request verification documents to confirm user identity
      3. Temporarily suspend accounts during security investigations
      4. Restore account access to verified original account holders
      5. Take appropriate actions against unauthorized account access including:
        1. Account access reversal
        2. Transaction reversal
        3. Account termination
        4. Reporting to relevant authorities
      6. Decline account recovery requests if:
        1. Insufficient proof of ownership is provided
        2. Investigation reveals conflicting information
        3. User fails to respond to verification requests
        4. Recovery attempts appear fraudulent
      7. Make all decisions regarding account security, investigation, and recovery at its sole discretion

    7. Token Distribution Authority

        1. Users may be required to provide a valid blockchain wallet address to qualify for token distribution

      4. Users acknowledge that participation in mining activities provides no guarantee of token distribution, and all accumulated balances remain subject to cPen Network's distribution authority, including the right to distribute different tokens than originally anticipated or advertised.
  9. Intellectual Property Rights

    1. Platform Ownership

      1. All rights, title, and interest in and to the cPen Network platform, including all copyrights, patents, trade secrets, trademarks, and other intellectual property rights are owned by Cpenio Inc.
      2. The cPen mobile application, website, software, algorithms, design, text, content, visual interfaces, graphics, compilation, computer code, products, and all other elements are protected by intellectual property laws
      3. No ownership rights are transferred to users through platform access or use
    2. Limited License

      1. Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the platform for personal, non-commercial purposes

      2. Users acknowledge that digital mining and cryptocurrency activities carry inherent risks, and by using the Service, users accept full responsibility for managing these risks.
      3. Users are solely responsible for securing their account credentials, private keys, and digital assets.
      4. cPen Network does not guarantee the recovery of lost tokens under any circumstances.
      5. This limitation of liability applies to all tokens generated, mined, or stored through the platform, including but not limited to $CPEN, $INK, and any future tokens.
      6. cPen Network makes no representations or warranties regarding the security, stability, or continuity of mining operations or token storage systems.
  12. Mining Program Terms

      4. One active mining session per user at any time

  15. Volatility of Crypto Currencies

    By accepting the Terms of Service you understand that blockchain technologies and associated coins or tokens are highly volatile due to many factors, including but not limited to adoption, speculation, technological and security risks.

    You also recognize that once the cPen token distribution starts, cPen Mainnet goes live or cPen is listed on an exchange, $CPEN will experience similar volatility and will be subject to the same factors faced by other cryptocurrencies. Recognize also that the cost of transactions on such technologies is variable and can increase at any time, causing an impact on any activities that take place on blockchains.

    You acknowledge these risks and represent that cPen Network cannot be held liable for such fluctuations or increased costs.

  16. Data Protection and Privacy

    cPen Network is committed to protecting user privacy and will collect, store, and process personal data in accordance with applicable laws and regulations. Users have the right to access, correct, or delete their personal information as permitted by law.

  17. Indemnification

    Users agree to indemnify and hold harmless cPen Network, its affiliates, and employees from any claims, damages, or liabilities arising from their use of the platform or breach of this agreement.

  18. Termination

    cPen Network reserves the right to terminate or suspend user accounts or services at its discretion, with or without cause.

  19. Governing Law

    This agreement shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.

  20. Amendments

    cPen Network reserves the right, at its sole discretion, to update or amend this agreement at anytime. The most current version of these Terms will be posted on our site. You are responsible for reviewing and becoming familiar with any such modifications. Use of the Services by you after any modification to the Terms constitutes your acceptance of the agreement as modified.

  21. Burnchase Program Terms

    1. Program Overview

      1. The Burnchase Program is a token burning mechanism where users permanently destroy supported cryptocurrency tokens in exchange for Dan credits.
      2. Dan credits ("Dan") are virtual credits used within the cPen Network platform with no cash value outside the platform.
      3. Participation in the Burnchase Program is voluntary and subject to these terms.
    2. Token Burning Agreement

      1. Token burns are permanent and irreversible. Once a burn transaction is confirmed on the blockchain, the tokens are permanently destroyed and cannot be recovered under any circumstances.
      2. Users acknowledge and accept that burned tokens are permanently removed from circulation and cannot be restored by cPen Network or any third party.
      3. cPen Network is not liable for user errors including but not limited to:
        1. Burning incorrect token amounts
        2. Burning the wrong token type
        3. Executing burns at unintended times
        4. Wallet or transaction errors
    3. Non-Refundable Transactions

      1. Token burns are non-refundable regardless of:
        1. Subsequent changes in token price or market value
        2. User change of mind after transaction confirmation
        3. Platform changes to Dan conversion rates
        4. Any other reason whatsoever
      2. Ambassador referral transfers are non-refundable. Tokens transferred to Community Ambassadors as referral rewards cannot be reclaimed or reversed.

      2. Dan cannot be withdrawn, exchanged for fiat currency, or converted to cryptocurrency.
      3. Dan conversion rates may change at any time without prior notice.
      4. Dan expires after 365 days of account inactivity (no login to the platform). Expired Dan cannot be recovered.
      5. Dan balance may be forfeited in whole or in part for violations of these Terms of Service.
      6. Earned Dan is non-refundable and non-transferable between accounts.
    5. Conversion Rates and Pricing

      1. cPen Network reserves the right to adjust Dan conversion rates at any time without prior notice.
      2. Price quotes for token burns are time-limited (default 5 minutes) and valid only during the specified validity period.
      3. There is no guarantee of rate consistency between transactions.
      4. Users are responsible for reviewing and accepting the current rate before confirming any burn transaction.
    6. Smart Contract and Blockchain Risks

      1. Users assume all risks associated with blockchain transactions including but not limited to:
        1. Smart contract vulnerabilities or exploits
        2. Network congestion and transaction delays
        3. Gas fees and transaction costs
        4. Transaction failures or reversions
        5. Blockchain network issues or outages
      2. cPen Network is not responsible for issues arising from third-party wallets, blockchain networks, or smart contract interactions.
    7. Supported Tokens

      1. cPen Network may add or remove supported tokens at any time without prior notice.
      2. Burning unsupported tokens or sending tokens to incorrect addresses may result in permanent loss without Dan credit. cPen Network bears no responsibility for such losses.
  22. Wall (Community Board) Terms

    1. Service Description

      1. The Wall is a Dan-powered community bulletin board where users can post services, projects, advertisements, and announcements.
      2. Users spend Dan credits to post content for specified durations.
      3. Wall posts are public and visible to all platform users.
    2. Dan Payment for Posts

      1. Dan spent on Wall posts is non-refundable under any circumstances including but not limited to:
        1. Post removal due to content moderation violations
        2. Unused post duration
        3. User-initiated post deletion
        4. Technical issues or platform maintenance
        5. Change of mind after posting
      2. Post pricing may change without notice. Users are responsible for reviewing current pricing before creating posts.
    3. Prohibited Content

      The following content is strictly prohibited on the Wall:

      1. Illegal goods, services, or activities
      2. Adult, sexually explicit, or NSFW content
      3. Weapons, firearms, explosives, or ammunition
      4. Drugs, controlled substances, or drug paraphernalia
      5. Pyramid schemes, multi-level marketing (MLM) recruitment, or Ponzi schemes
      6. Counterfeit goods or intellectual property violations
      7. Personal information sales or data harvesting
      8. Discriminatory, hateful, or offensive content
      9. Scams, fraudulent offers, or deceptive practices
      10. Misleading or false information
      11. Copyright or trademark infringement
      12. Spam, duplicate posts, or excessive self-promotion
      13. Any content that violates applicable laws or regulations
    4. Content Requirements

      1. All posts must be accurate, honest, and not misleading.
      2. Service offerings must include clear pricing information where applicable.
      3. Users must respect intellectual property rights of others.
      4. Users should respond to inquiries regarding their posts in a timely manner.
      5. Posts must comply with all applicable laws and regulations.
    5. Content Moderation Rights

      1. cPen Network reserves the right to remove, edit, or hide any content without prior notice.
      2. AI-powered automated moderation may be applied to all Wall content.
      3. Posts may be held for manual review before becoming visible.
      4. Decisions regarding content removal or moderation actions are final and at cPen Network's sole discretion.
      5. No appeal process is guaranteed for removed or moderated content.
      6. Repeated violations may result in account suspension or permanent ban.
    6. Post Visibility and Duration

      1. Posts become visible only after Dan payment is verified and moderation is complete.
      2. Posts expire automatically after the selected duration.
      3. Featured placement is available for additional Dan at cPen Network's discretion.
      4. There is no guarantee of specific reach, engagement, or response to posts.
    7. User Interactions and Liability

      1. Users are solely responsible for verifying the legitimacy and accuracy of other users' posts.
      2. cPen Network does not verify, endorse, or guarantee any posts or the users who create them.
      3. All transactions, agreements, or interactions between users are conducted at their own risk.
      4. cPen Network is not responsible for disputes, losses, or damages arising from user interactions on the Wall.
    8. Age Requirement

      1. Users must be at least 18 years of age to post content on the Wall.
      2. By posting on the Wall, users confirm they meet this age requirement.
  23. Community Ambassador Program Terms

    1. Program Description

      1. The Community Ambassador Program (also referred to as "Ambassador") is a referral rewards program within cPen Network.
      2. Qualified Ambassadors earn token rewards when users they have referred participate in the Burnchase Program.
      3. Referral rewards are paid in tokens, not Dan credits.
    2. Independent Status

      1. Community Ambassadors are independent users of the cPen Network platform and are not employees, contractors, agents, partners, or official representatives of cPen Network or Cpenio Inc.
      2. Ambassadors have no authority to make commitments, representations, or statements on behalf of cPen Network.
      3. The Ambassador designation does not create any employment, agency, partnership, joint venture, or franchise relationship between the Ambassador and cPen Network.
      4. cPen Network is not responsible for any actions, statements, representations, or conduct of Ambassadors.
      5. Users interacting with Ambassadors do so at their own risk and should not rely on any claims made by Ambassadors regarding cPen Network services, products, or potential earnings.
    3. Eligibility Requirements

      To become a Community Ambassador, users must meet ALL of the following requirements:

      1. Completed and approved Know Your Customer (KYC) verification
      2. Account age of minimum 30 days since registration
      3. Account in good standing (not suspended, banned, or flagged for violations)
      4. At least 5 active, KYC-verified referrals
    4. Referral Reward Terms

      1. Ambassadors receive 20% of tokens burned by their referred users. This percentage may change at cPen Network's discretion.
      2. Referral rewards are non-refundable once transferred to the Ambassador's wallet.
      3. Only single-level referrals qualify for rewards. Multi-level or chain referral rewards are not supported.
      4. Non-Ambassador referrers (users who have not qualified for the program) do not receive token rewards.
      5. Referral rewards are subject to blockchain transaction fees which are the responsibility of the recipient.
    5. Ambassador Status and Revocation

      1. Ambassador status may be granted automatically if all eligibility requirements are met, or may require manual review for flagged accounts.
      2. Ambassador status can be revoked at any time for any of the following reasons:
        1. Violation of these Terms of Service
        2. Fraudulent referral activity
        3. Abuse of the Ambassador program
        4. Account suspension or ban
        5. Any other reason at cPen Network's sole discretion
      3. Revocation of Ambassador status may result in loss of future referral rewards but does not affect tokens already received.
    6. Badge System

      1. Ambassadors are assigned badge levels based on their performance:
        1. Bronze: Default for new Ambassadors
        2. Silver: 25+ successful referrals OR $500+ USD earned from referral rewards
        3. Gold: 100+ successful referrals OR $5,000+ USD earned from referral rewards
      2. Badge levels and requirements are subject to change at cPen Network's discretion.
    7. Anti-Abuse Measures

      1. Maximum referral limits may apply per time period.
      2. Suspicious referral patterns may result in review, suspension, or revocation of Ambassador status.
      3. The following activities are strictly prohibited and may result in immediate revocation and forfeiture of rewards:
        1. Creating fake accounts for referral manipulation
        2. Self-referrals or circular referral schemes
        3. Offering monetary incentives for referrals outside the program
        4. Using bots or automated systems to generate referrals
        5. Any other fraudulent or deceptive referral practices
    8. No Guaranteed Income

      1. Ambassador rewards depend entirely on referral activity and are not guaranteed.
      2. There is no guarantee of any specific earnings from the Ambassador program.
      3. cPen Network may modify, suspend, or terminate the Community Ambassador Program at any time without prior notice.
      4. Past performance or earnings do not guarantee future results.
